Terms of Service

To use Bockaa you must create an account by providing accurate information including your name, property name, and a valid email address or phone number. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 18 years old and have legal authority to enter into contracts on behalf of your business to create an account.

Bockaa is offered as a monthly or annual subscription. Prices are listed in Indian Rupees (₹) inclusive of applicable GST.

Free trial: Every new account begins with a 14-day free trial. No credit card is required during the trial period.

Billing: After the trial, your subscription will be charged on a recurring basis (monthly or annually) based on the plan you select.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods.

Failed payments: If a payment fails, we will notify you and retry. After 7 days of non-payment, your account will be suspended. After 30 days of suspension, your account and data may be deleted.

You agree not to use the Service to:

• Store or transmit illegal content or content that violates the rights of any third party
• Attempt to gain unauthorised access to our systems or other users' accounts
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service
• Use the Service in a way that imposes an unreasonable load on our infrastructure
• Resell or sublicense access to the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these rules.

You own all data you enter into Bockaa, including booking records, guest profiles, and financial data ("Your Data"). We claim no intellectual property rights over Your Data.

You grant us a limited, non-exclusive licence to store, process, and transmit Your Data solely to provide and improve the Service.

Upon termination of your account, you may request an export of Your Data in a machine-readable format within 30 days of termination.

The Bockaa software, brand, design, and all content we create (excluding Your Data) are our intellectual property or that of our licensors. These Terms do not transfer any ownership of our intellectual property to you.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code.

To the maximum extent permitted by applicable law, Bockaa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Indian law.

We target 99.9% monthly uptime for the Bockaa service. We will notify you in advance of planned maintenance windows. In the event of an unplanned outage, we will communicate status updates via our website and to your registered email.

Bockaa is provided "as is" and "as available". We do not warrant that the Service will be error-free or that data stored will never be lost, though we maintain backups to minimise data loss risk.

You may terminate your account at any time via account settings or by emailing hello@bockaa.com.

We may suspend or terminate your account immediately if you breach these Terms, fail to pay after the grace period, or if we are required to do so by law.

Upon termination, your right to use the Service ends. We will retain your data for 30 days after termination to allow for an export request, after which it will be deleted.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions.

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of Malappuram, Kerala, India.

We may update these Terms from time to time. We will notify you of material changes by email and via an in-app notice at least 7 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
